The upcoming Rajya Sabha elections on March 16 have generated significant national interest. Among the announced candidates, Maneka Guruswamy has emerged as the most discussed name. The All India Trinamool Congress (TMC) nominated her as one of its four candidates from West Bengal, and her selection immediately triggered widespread debate.

Notably, Guruswamy openly identifies as a member of the LGBTQ community. Therefore, if elected, she could become one of the first openly LGBTQ representatives in the Indian Parliament. As a result, her candidacy represents more than a routine political nomination; it signals a potential shift in representation and inclusivity.

A Key Figure in the Section 377 Verdict

Currently, Maneka Guruswamy serves as a senior advocate in the Supreme Court of India. Over the years, she has built a strong reputation in constitutional law. Most importantly, she played a crucial role in challenging Section 377 of the Indian Penal Code.

In 2018, the Supreme Court delivered its historic judgment that decriminalised consensual same-sex relationships. Guruswamy actively argued for the petitioners in that landmark case. Consequently, the verdict reshaped India’s legal framework on LGBTQ rights and strengthened constitutional protections.

Beyond this case, she has handled matters involving civil liberties, administrative law, and public interest litigation. In recognition of her expertise, the Supreme Court designated her as a Senior Advocate in 2019.

Strong Academic and Family Background

Born in Hyderabad, Guruswamy shares deep roots with the erstwhile united Andhra Pradesh. Her father, Mohan Guruswamy, is a noted economist and political thinker who advised former Prime Minister Atal Bihari Vajpayee. Meanwhile, her grandfather practised law at the Andhra Pradesh High Court. Unsurprisingly, this legal legacy influenced her career choice from an early age.

Academically, she excelled at every stage. She completed her BA LLB (Hons.) at the National Law School of India University in Bengaluru. Later, she earned a prestigious Rhodes Scholarship to study at the University of Oxford, where she completed her Bachelor of Civil Law degree. In addition, she obtained an LLM from Harvard Law School, strengthening her command of international and constitutional law.

International Recognition and Teaching Career

Over time, Guruswamy expanded her influence beyond courtrooms. She taught at globally respected institutions, including Columbia Law School, Yale Law School, New York University School of Law, the University of Toronto, and Harvard Law School. Through these engagements, she contributed to academic debates on constitutional reform and human rights.

Moreover, international platforms recognised her contributions. TIME magazine included her in its TIME 100 list of the world’s most influential people. Such recognition elevated her global profile and underscored her impact.

Advocacy Rooted in Equality

Throughout her legal career, Guruswamy has consistently advocated for dignity, equality, and personal liberty. For instance, she represented petitioners seeking legal recognition for same-sex marriages. During those hearings, she argued that excluding same-sex couples from marriage violated constitutional guarantees.

At the same time, she remained open about her own same-sex relationship. Despite facing social resistance, she chose transparency over silence. Consequently, many supporters view her as both a legal reformer and a symbol of courage.

Political Implications in West Bengal

The March 16 elections will fill 37 Rajya Sabha seats nationwide. In West Bengal, five seats are falling vacant. Political calculations suggest that the Trinamool Congress holds a strong advantage in at least four of them.

Given the party’s numerical strength in the 294-member Assembly, analysts believe Guruswamy has a clear path to victory unless opposition parties alter the equation strategically. Therefore, her nomination carries both symbolic and electoral significance.

A Defining Moment Ahead?

If voters elect her, Guruswamy’s entry into Parliament could mark a defining moment for inclusive representation in Indian politics. More importantly, it would reflect the growing acceptance of diverse voices in democratic institutions.

From arguing constitutional battles in the Supreme Court to stepping onto the national political stage, her journey has been both unconventional and historic. As election day approaches, attention remains firmly fixed on West Bengal.

Ultimately, the outcome may shape not only her political future but also the broader narrative of representation in India’s Parliament.
